PGP FOR INDIVIDUALS WITH REASONABLE ACCOMODATIONS
The Officers have received several inquiries regarding the PGP eligibility of workers who have been granted reasonable accommodations.
In 2009, Local 13 filed Union Complaints on behalf of several workers who had reasonable accommodations, were not able to get a job they could perform with their restrictions and were denied PGP. These Union Complaints were referred to the Coast Labor Relations Committee. In CLRC Meeting No. 22-09, the Coast Labor Relations Committee denied the requests for PGP when an individual who has been granted an ADA reasonable accommodation is unable to get a job that meets their accommodation. The Coast Labor Relations Committee determined that pursuant to Section 20 of the PCLCD, such individuals are not eligible for PGP because they do not meet the plan’s eligibility requirements.
Individuals who would like to review the relevant section of CLRC Meeting No. 22-09 are welcome to contact the Secretary-Treasurer. Individuals who wish to draft a Caucus Resolution proposing to negotiate changes to PGP eligibility are invited to contact Irene Huerta, Assistant to the President, for further information regarding the Caucus Resolution Process. Individuals with reasonable accommodation who wish to revise their accommodation request are invited to attend the next regular ADA JPLRC meeting.
